Clay Color Academy #2

I picked up my child from Clay Color Academy and noticed my child was being carried to me, when normally he runs out to me with his arms up wanting me to pick him up. It was questioning but I took him from the care giver and proceeded out the door. While I was trying to place his arms in the car seat he started flinching like he didn’t want me to touch his left arm. So I just placed the strap over his arm and locked the leg attachments. I tried to hand him his cup and he reached over his left arm and pushed it away. When I reached my daughter’s house across town, I went to unstrap the buckles from his right arm and he let me but when I tried to remove the strap from his left arm he whined and flinched again At that time I tried to lift his shirt to see if I could see any bruises or marks on his body but he wouldn’t allow me to touch him. That’s when I called my daughter to inform her that he was acting like he was in pain. She advised me to take him to Kids Street urgent care. When I arrived I placed him on the ground for me to see how he walked because I remembered that he was carried to me. As he was walking inside the hospital I noticed he was not moving his left arm. The nurse came out to the lobby and took us back to evaluate his body and he started crying. Then she advised me that they needed to check everything and it would hurt him but it was their procedure. As she was checking his left fingers, hand and elbow, she stated to me there was definitely something wrong with his arm. Doctor Alicia O’Brien arrived and took a look at his arm and asked me about his hand turning colors I stated I didn’t notice it. She advised me that it looked strange and that the top of his hand was turning purple. By that time my Daughter had arrived to the hospital. They took him to x-ray and couldn’t get a proper exam because he wouldn’t allow her to bend his arm, but Dr. O’Brien did advise us that she do see that his left elbow was dislocated. My daughter called his speech therapist to ask if she noticed anything and she stated “ I told the teacher he was acting funny” and then she called the daycare to notified them of the situation and asked them to review the camera to see if there was an incident that caused the injury. Quanda Clay the owner called back and stated she did see where he was on the playground and another baby grabbed him and they both fell. This was at 10am in the morning. I then asked her why weren’t we notified because if they fell so hard that it dislocated his elbow it had to be very painful. She did not respond stating it was not something her teachers had done. I then advised my daughter to go to the daycare and check the cameras. He was dropped off at 7am and to check back to then. As we were talking to the daycare about the incident I advised her he would not be returning. She stated he does not have to come back but she had signed a contract that states she will have to still pay for the 2 weeks he will not be there. I then advised her it’s also in the policy and or contract that the daycare is supposed to notify the parents of an injury to the children and she would have to send me to court for the payment. She then stated well, I will excuse the 2 weeks notice and payment. At that time I notified the Georgia Department of Early Care and Learning Child Care Services.

If you are looking for a safe space for your child this is not it. How is it even considered excusable to have a child in school all day with a dislocated arm and not contact the parent? Please make it make sense!
